Canna West Seattle Dispensary App Terms of Use
  1. Overview

These terms of use (“Terms of Use”) are entered into between you and LTC, LLC dba Canna West Seattle (“Canna West Seattle,” “we,” or “us”). The Terms of Use govern your access to and use of the Canna West Seattle mobile application including any content, functionality, and services offered on or through it (the “App”). 

By using the App, you agree to be bound and abide by these Terms of Use. Canna West Seattle may terminate your ability to use the App without notice if you do not comply with the Terms of Use. If you do not agree to these Terms of Use, you must not access or use the App.

Canna West Seattle reserves the right to make changes to the App and to the Terms of Use at any time. All changes are effective immediately when posted. Your continued use of the App following the posting of the revised Terms of Use means that you accept and agree to the changes.

All Information (as defined in the Privacy Notice) that Canna West Seattle collects on this App is subject to our Privacy Notice posted on the App. By using the App, you consent to all actions taken by us with respect to your Information in compliance with the Privacy Notice. The Privacy Notice is incorporated into and governed by these Terms of Use. To the extent there is a conflict, the Terms of Use supersede the Privacy Notice.  

The App will provide information about cannabis products but does not offer any products for sale directly through the App. The App will send you information about cannabis products and related Canna West Seattle products and services through push notifications on your mobile phone. By agreeing to these Terms of Use, you are agreeing to receive communications from Canna West Seattle though emails, App notifications, and other electronic means about discounts, products, marketing, promotions, services, and other information related to Canna West Seattle through the contact information you have provided.

  1. Authorized and Prohibited Users 

You may only use this App if you are:

  • 21 years of age or older.  This App is only for those who are of legal age to purchase Canna West Seattle’s products. By using this App, you represent that you are at least 21 years old. 
  • A Washington state resident.  This App is only intended for Washington residents. By using this App, you represent that you are a Washington resident.  

Canna West Seattle reserves our right to restrict any user’s access who we believe does not meet these requirements, because they have violated our Terms of Use, or at our own discretion for no reason at all.

  1. Intellectual Property

The App and its entire contents, data, features, and functionality (including but not limited to text, graphics, video, logos, button icons, databases, and images) (“App Content”) are the property of Canna West Seattle or its licensors and are protected by copyright, trademark, and other intellectual property laws, except as indicated below. 

The Canna West Seattle name and related logos are trademarks and service marks (“Marks”) of Canna West Seattle. Canna West Seattle Marks may not be used without advance written permission of Canna West Seattle, including in connection with any product or service that is not provided by Canna West Seattle, in any manner that is likely to cause confusion, or in any manner that disparages, discredits, or misrepresents Canna West Seattle. Other products or company names mentioned on the App may be trademarks or service marks of their respective owners.

If you believe that any content on the App violates your intellectual property rights, please notify Canna West Seattle as described in Section 23.

  1. Limited License and Prohibited Uses

Canna West Seattle grants you a personal, royalty-free, non-assignable, revocable, and non-exclusive license to access and use the App Content as an informative resource while using the App. Any other use, including the reproduction, modification, distribution, transmission, republication, framing, display, or performance of App Content without prior permission of Canna West Seattle is strictly prohibited. You may not download, print, copy, distribute, or otherwise use App Content for commercial purposes, including publication, sale, or personal gain. You may not remove any Marks or other proprietary notices, including, without limitation, attribution information, credits, and copyright notices that have been placed on or near the App Content.

You may use the App only for lawful purposes and in accordance with these Terms of Use. You agree that you will not:

  • Use the App in any way that violates any applicable law or regulation, including anything that would violate state or federal law related to cannabis.  
  • Use the App for the purpose of exploiting, harming, or attempting to exploit or harm anyone in any way.
  • Send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Terms of Use.
  • Transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation.
  • Impersonate or attempt to impersonate Canna West Seattle, a Canna West Seattle employee, another user or any other person or entity (including, without limitation, by using email addresses associated with any of the foregoing).
  • Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by Canna West Seattle, may harm Canna West Seattle or users of the App or expose them to liability.
  • Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party’s use of the App, including their ability to engage in real time activities through the App.
  • Use any robot, spider or other automatic device, process or means to access the App for any purpose, including monitoring or copying any of the material on the App.
  • Use any manual process to monitor or copy any of the material on the App or for any other unauthorized purpose without Canna West Seattle’ prior written consent.
  • Use any device, software, or routine that interferes with the proper working of the App.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App.
  • Attack the App via a denial-of-service attack or a distributed denial-of-service attack.
  • Otherwise attempt to interfere with the proper working of the App.
  1. Account Registration

To access the App, you may be asked to provide registration details or other Information. It is a condition of your use of the App that all Information you provide is complete, current, and accurate. All Information you provide to register with the App or otherwise is governed by our Privacy Notice, and you consent to all actions Canna West Seattle takes with respect to your Information consistent with our Privacy Notice.

  1. Use and Protection of Login Credentials

You are responsible for maintaining the confidentiality of your user name and password (“Login Credentials”). You are responsible for all uses of your account and Login Credentials, whether or not authorized by you. You agree to notify Canna West Seattle immediately of any unauthorized access to or use of your account or Login Credentials or any other breach of security. Canna West Seattle reserves the right to disable your Login Credentials at any time in its sole discretion for any or no reason, including if, in Canna West Seattle opinion, you have violated any provision of these Terms of Use.

  1. Third Party Content

This App may include content provided by third parties. All statements and opinions expressed by third parties are solely the opinions and the responsibility of the person or entity providing those materials. Those materials do not necessarily reflect the opinion of Canna West Seattle. Canna West Seattle is not responsible for the content or accuracy of any materials provided by any third parties.

  1. Links to other Websites

Canna West Seattle may provide links to external websites for the convenience of App users. The inclusion of an external link on this App does not constitute or imply support or endorsement of any kind. Canna West Seattle does not control those websites, is not responsible for their content or function, and is not responsible for any loss or damage that may arise from your use of them. If you decide to access the third party website linked to this App, you do so entirely at your own risk and subject to the terms and conditions of use and the privacy notice for such websites.

  1. Wireless Access Charges

Certain App functions may require data access, and the provider of data access for your device may charge you data access fees in connection with your use of the App. You are solely responsible for any data access or other charges you incur.

  1. Payments, Fees, and Other Charges

You are solely responsible for all fees associated with your use of the App if any, including paid plans and those listed within the App itself. You are solely responsible for any and all duties, taxes, levies, or fees (including sales, use, or withholding taxes) imposed by any authority on you by virtue of your transactions through the App.

  1. Uninstalling the App

Uninstallation methods may vary depending on your device. To uninstall this App, please use the application manager provided with your device or consult your device manual for reference.

  1. Change or Update to the App; Termination

Canna West Seattle shall have the right for any reason, in its sole discretion, to terminate, change, suspend, or discontinue, temporarily or permanently, any aspect of the App, including but not limited to content or features, without notice to you. We may also impose limits on certain features and services or restrict your access to parts or all of the App with or without notice or liability. 

From time to time, Canna West Seattle may make available updates or upgrades to the App via software download or other means. Such download may occur automatically without the need for an act on your part, or it may require you to manually download an update or upgrade through the same source from which the App was originally downloaded. Certain functions of the App may be modified or discontinued as a result of any such update or upgrade or may not be available if you have not downloaded all updates and upgrades made available by Canna West Seattle or otherwise.

The App may contain information about Canna West Seattle or other products or services. The information in the App is accurate as of the date the App is made available for download to you. Such information about Canna West Seattle or other products or services may be updated from time to time, including, without limitation, when the App may be updated or upgraded. You should periodically check whether an updated or upgraded version of the App is available for download.

  1.   Apple App Store

If you download the App from a device made by Apple, Inc. (“Apple”) or from Apple’s App Store, you agree that:

  • These Terms of Use are between Canna West Seattle and you; Apple is not a party to these Terms of Use.
  • The license granted to you is limited to a personal, limited, non-exclusive, non-transferable right to install the App on the Apple device(s) authorized by Apple that you own or control for personal, non-commercial use, subject to the usage rules set forth in Apple’s App Store Terms of Services.
  • Apple is not responsible for the App or the content thereof and has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any, to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Apple is not responsible for addressing any claims by you or a third party relating to the App or your possession or use of the App, including without limitation (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
  • In the event of any third party claim that the App or your possession and use of the App infringes such third party’s intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such intellectual property infringement claim.
  • You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third party beneficiaries of these Terms of Use and upon your acceptance of the terms and conditions of these Terms of Use, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third party beneficiary hereof.
  • Canna West Seattle expressly authorizes use of the App by multiple users through the Family Sharing or any similar functionality provided by Apple.
  1. Disclaimer of Warranties

YOU EXPRESSLY AGREE THAT USE OF THE APP AND CONDUCTING TRANSACTIONS RELATED TO IT ARE AT YOUR SOLE RISK. WHILE CANNA WEST SEATTLE ATTEMPTS TO PRESENT ACCURATE INFORMATION ON THE APP, THIS APP IS PROVIDED ON AN “AS-IS” BASIS. CANNA WEST SEATTLE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OR CONTENT OF THIS APP OR ANY OTHER WEBSITE TO WHICH IT IS LINKED. 

TO THE EXTENT PERMITTED BY LAW, CANNA WEST SEATTLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES OF NON-INFRINGEMENT OF ANY PATENT OR OTHER INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY. CANNA WEST SEATTLE DOES NOT WARRANT THAT YOUR PURCHASE OR USE OF CANNABIS PRODUCTS IS LEGAL.

YOU UNDERSTAND THAT CANNA WEST SEATTLE CANNOT GUARANTEE THE ACCURACY OR AVAILABILITY OF PRODUCTS OR PRODUCT DESCRIPTIONS ON THE SITE (I.E., PRICING, PRODUCT IMAGES, AND INDICATIONS OF AVAILABILITY) AS AVAILABILITY AND PRICE MAY VARY AND THE PARTICULAR TECHNICAL SPECIFICATIONS AND SETTINGS OF YOUR COMPUTER AND ITS DISPLAY COULD AFFECT THE DISPLAY OF PRODUCT COLORS.

YOU ACKNOWLEDGE THAT UNDER FEDERAL LAW CANNABIS IS ILLEGAL AND CONDUCT INCLUDING, BUT NOT LIMITED TO, THE MANUFACTURING, DISTRIBUTING, DISPENSING, OR POSSESSION OF CANNABIS CAN BE SUBJECT INDIVIDUALS TO ARREST AND/OR PROSECUTION. YOU FURTHER ACKNOWLEDGE THAT THE CULTIVATION, MANUFACTURE, DISTRIBUTION, USE, AND POSSESSION OF CANNABIS IS ILLEGAL IN THE STATE OF WASHINGTON, UNLESS PARTICIPANTS ACT IN ACCORDANCE WITH THE STATE’S CANNABIS LAWS AND REGULATIONS. CANNA WEST SEATTLE DISCLAIMS ANY AND ALL LIABILITY RELATING TO THE USE OF ITS APP IN VIOLATION OF ANY FEDERAL OR STATE LAWS OR REGULATIONS.

  1. Limitation of Liability

CANNA WEST SEATTLE, ITS DIRECTORS, ITS CONTRACTORS, AND ITS EMPLOYEES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS APP OR PRODUCTS SOLD OR ASSOCIATED WITH THE APP, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, PUNITIVE, AND CONSEQUENTIAL DAMAGES. YOUR SOLE REMEDY UNDER THESE TERMS OF USE IS TO STOP USING THE APP AND THE PRODUCTS. CANNA WEST SEATTLE WILL NOT BE LIABLE FOR ANY REASON IF ALL OR ANY PART OF THE APP IS UNAVAILABLE AT ANY TIME OR FOR ANY PERIOD.

CANNA WEST SEATTLE’S MAXIMUM LIABILITY, WHETHER BY STATUTE, IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, PRODUCT LIABILITY, STRICT LIABILITY, OR OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR ITS CONTENT, WILL NOT EXCEED $100.

  1. Indemnification

You agree to defend, indemnify and hold harmless Canna West Seattle, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any liabilities, damages, judgments, awards, losses, costs, third party claims, expenses and fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the App, including, but not limited to, your content, any use of the App Content, services, and products other than as expressly authorized in these Terms of Use.

  1. Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE APP MUST BE COMMENCED WITHIN THREE (3) MONTHS AFTER THE EVENT GIVING RISE TO THE ACTION OR CLAIM OCCURRED, REGARDLESS OF WHEN YOU KNEW OR SHOULD HAVE KNOWN ABOUT IT; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

  1. Injunctive Relief

You agree that a breach of these Terms of Use will cause irreparable injury to Canna West Seattle for which monetary damages would not be an adequate remedy, and Canna West Seattle shall be entitled to seek equitable relief, in addition to any remedies it may have hereunder or at law, without having to post a bond or other security.

  1. Waiver and Severability

No waiver by Canna West Seattle of a term or condition set forth in these Terms of Use shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Canna West Seattle to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

  1. Entire Agreement

The Terms of Use and our Privacy Notice constitute the sole and entire agreement between you and Canna West Seattle with respect to the App and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the App.

  1. Term and Termination

These Terms of Use will remain in full force and effect while you use the App. Even after you are no longer a user of the App, those provisions of these Terms of Use that by their nature are intended to survive will remain binding on you, including Sections 1, 3, 5, 10, 12–23, and the Privacy Notice.

You agree that Canna West Seattle, in its sole discretion, may suspend or terminate your access to the App (or any part thereof) for any reason, with or without notice, and without any liability to you or to any third party for any claims, damages, costs, or losses resulting therefrom.  

  1. Applicable Law, Binding Arbitration, and Class Action Waiver

PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY REQUIRE YOU TO AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.

The laws of the State of Washington will govern these Terms of Use and any disputes under them, without giving effect to any principles of conflicts of laws.

Any controversy or claim arising out of or relating to these Terms of Use shall be exclusively settled by arbitration administered by the American Arbitration Association (or other arbitration association chosen by Canna West Seattle if American Arbitration Association is unavailable) in accordance with its Commercial Arbitration Rules, then in effect. This arbitration provision is governed by the Federal Arbitration Act. The arbitration proceedings shall be held in King County, Washington. Any arbitration award may be entered in a court of competent jurisdiction.

All claims and disputes within the scope of this arbitration agreement must be arbitrated or litigated on an individual basis and not on a class basis. Claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user.

Canna West Seattle may contact you regarding these Terms of Use or the Privacy Notice using any contact information you provide, or by any other means if you do not provide contact information. If you no longer wish to receive communications from Canna West Seattle, you can click on the “unsubscribe link” provided in such communications, change the App notification settings, or contact us at info@cannaws.com

  1. The Types of Information that Canna West Seattle Collects about You and How Canna West Seattle Collects Information about You

Canna West Seattle may collect two types of information from you when you visit the Platform: Personal Information and Non-Personal Information (collectively “Information”).  

  • “Personal Information” refers to data by which you may be personally identified, such as name, address and email address.
  • “Non-Personal Information” means data that is about you, but does not identify you specifically. If you do nothing during your visit to our Platform but browse, read pages, or view content, we will gather and store Information about your visit that does not identify you personally.

The specific type of Information will vary based on your activities on the Platform.

  • Automatically as you navigate through the Platform.
  • Through third parties, including but not limited to our marketing vendors.

Information You Provide Directly to Canna West Seattle. The Information that you provide us directly through our Platform may include:

  • Information that you provide when you report a problem with our Platform. We may ask you for additional Information to resolve the problem.
  • Information that you provide in connection with an inquiry.

  • Information you provide when you complete a transaction through the Platform.
  • Your responses to surveys, contest, or other marketing campaigns.

Information Automatically Collected from You. The Information that Canna West Seattle may automatically collect and store about you when you visit the Platform may include:

  • Your location.
  • Your device information.
  • Your interactions with the Platform, such as the length of time you use the Platform and the buttons or icons you click on during your use.
  • The Internet Protocol Address and domain name used. The Internet Protocol address is a numerical identifier assigned either to your Internet service provider or directly to your computer. We use the Internet Protocol Address to direct Internet traffic to you.
  • The type of browser and operating system you used.
  • The date and time you visited the Platform.
  • The web pages or services you accessed at the Platform.
  • The website you visited prior to coming to the Platform.

The methods we use for automatic data collection may include cookies:

  • A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Platform. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Platform.
  1. How Canna West Seattle Uses Information It Collects about You and the Purpose for the Collection and Use

We use Information that we collect about you or that you provide to us, including any Personal Information, for the following purposes:

  • To present our Platform and the content on it to you.
  • To provide you with data, products, or services that you request from us.
  • To carry out our obligations and enforce our rights.
  • To notify you about changes to our Platform or any services we offer.
  • To communicate with you regarding the Platform and our services, including for marketing purposes.
  • To develop and improve the Platform and the services we provide.
  • To conduct loyalty and other marketing programs.

  • To fulfill any other purpose for which you provide it.
  • For any other purpose with your consent.

Platform statistics are compiled into traffic reports, which help Canna West Seattle understand, anticipate, and respond to user needs. If we learn, for example, of heightened interest in certain aspects of the Canna West Seattle Platform, we may feature that information. This Information helps us create a better overall experience for Platform users.

Canna West Seattle will retain your Information for as long as necessary to provide the services you have requested, comply with our legal obligations, resolve disputes, and enforce our agreements.  

  1. How Canna West Seattle Protects Your Information

We have implemented measures designed to protect your Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, the internet is not completely secure. Although we are working to protect your Information, we cannot guarantee the security of your Information either in transmission or when stored. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.

  1. When Canna West Seattle Shares Your Information

We may disclose Personal Information that we collect or you provide as described in this Privacy Notice:

  • To our subsidiaries and affiliates, where applicable.
  • To contractors, service providers, and other third parties we use to support our business.
  • To a buyer or other successor (potential or actual) in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Canna West Seattle’s assets, including any related due diligence.
  • To fulfill the purpose for which you provide it.
  • For any other purpose disclosed by us when you provide the Information.
  • With your consent.

  • To enforce or apply our Terms of Use.

Canna West Seattle does not sell any of your Personal Information.  

We may use and disclose Non-Personal Information about our users without restriction.

  1. Third Parties Providing Services on Our Behalf

We use third parties to host the Platform, design and operate the Platform features, and to perform administrative, analytics, and other services. Services these third parties provide include providing information to Canna West Seattle about the use of the Platform and personalized content or information specific to your use of the Platform. We may disclose your Information to these companies so they can carry out these services. These companies are bound by contractual obligations to keep Information confidential.

  1. Information From People Under The Age Of 21

The Platform is intended only for individuals aged 21 and older, as explained further in the App Terms of Use. Canna West Seattle does not knowingly collect any Information from users under that age through the Platform. If you are under that age, do not provide any Information about yourself to Canna West Seattle, including your name, address, telephone number, or email address. If you become aware that Information of someone under that age has been provided, please contact us using the information in Section 11 of this Privacy Notice.
